This means that the police aren\u2019t allowed to stop you without probable cause to believe that you have broken the law. However, the United States Supreme Court ruled in\u00a0<a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/496\/444\/case.html\"><em><strong>Michigan v. Sitz<\/strong>\u00a0<\/em><\/a>that there is an exception to the Fourth Amendment where DUI checkpoints are concerned. The Court reasoned that the intrusion of liberty imposed by the checkpoint was slight as weighed against the protection of public safety\u00a0 by deterring and catching <img loading=\"lazy\" decoding=\"async\" class=\"size-thumbnail wp-image-435 alignleft\" src=\"https:\/\/fullerton-dui-lawyer.com\/wp-content\/uploads\/2018\/06\/law-23-150x150.jpg\" alt=\"dui lawyer in fullerton\" width=\"150\" height=\"150\" \/>drunk\u00a0drivers. Thus, the court held that DUI checkpoints are Constitutionally permissible so long as certain criteria were met to ensure the limited intrusion of a DUI checkpoint.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"left\">In 1987 the California Supreme Court enumerated the criteria necessary to make a DUI checkpoint legal in\u00a0<a href=\"https:\/\/scocal.stanford.edu\/opinion\/ingersoll-v-palmer-30801\"><strong><em>Ingersol v. Palmer<\/em><\/strong><\/a>. The eight factors listed above come directly from\u00a0<em><strong>Ingersol<\/strong><\/em>.
